The Labour Market Impact Assessment (LMIA) is overseen by Employment and Social Development Canada (ESDC). A neutral or positive LMIA is issued by ESDC for a migrant worker when ESDC is satisfied that there is no Canadian citizen or PR holder available to do it. A negative LMIA is given when Canadian citizens are available for jobs, and hiring a migrant will harm them.
Typically, Canadian employers hire migrant workers only for jobs with neutral or positive LMIA. Once a migrant worker is informed that LMIA for a job is granted, the migrant can apply with IRCC to get a Canada work visa permit. Once given, they can move to Canada to work for the employer.
If a Canadian employer is hiring for a job in Quebec, you, as a migrant, must get a Certificat d'acceptation du Québec (CAQ). CAQ application needs to be submitted to MIFI or Ministère de l'Immigration, Francisation et de l'Intégration of Quebec at same the time as LMIA is submitted to ESDC. LMIA is not required when work visa permits are referred to as LMIA exempt including:-
a. jobs that are part of international agreements such as the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP), North American Free Trade Agreement (NAFTA), or Comprehensive Economic and Trade Agreement (CETA).
b. There are significant economic, social, or cultural benefits to Canadians.
c. Due to reciprocal agreements, Canada has entered with other nations, such as youth and teacher exchange programs.
d. Help international students studying in Canada to fulfill their academic requirements, known as co-op placements.
e. Allow accompanying spouse/common-law partners to work in Canada.
f. To facilitate charitable or religious work.
g. Help a refugee claimant to support themselves.
h. Eligible PR holders in Canada are available.
i. When migrant workers and their dependents on employer-specific work permits in Canada face abuse.
Yes, migrant workers can choose to apply online for their work permit. However, if HIRS has issued guidance for how a job application is to be submitted at the port of entry of Canada, and if an individual chooses to apply online, options are limited if they face unexpected delays.
If migrant workers apply online for an LMIA-exempt work permit, a new LMIA exemption number is required to submit a 2nd application at the Canadian POE. Note that all LMIA-exempt numbers can be used only once for each application. In such cases, the HIRS pays the CAD 230 employer compliance fee for a 2nd time, and the migrant worker must pay the required work permit application fees for a 2nd time.
If the 2nd application is to be considered after an initial online application was submitted, qualified advice can be given only by regulated Canadian immigration consultants in HIRS.
a. Activate your work permit after applying from inside Canada
If your Canada work visa permit application is approved after applying from inside Canada, you will get an approval letter from IRCC regarding the same. If you apply online, the approval letter will be sent to your email address. If you use a paper-based application, the approval letter will arrive at your registered mailing address, as mentioned in the application.
After you receive the approval letter, your Canada work visa permit will arrive by mail. Your permit will have already been activated by the time it reaches you, allowing you to start work in Canada using the permit immediately.
b. Apply from outside Canada to activate your work permit
If your application for a Canada work visa permit is approved after you apply from outside Canada, you will receive a confirmation letter. There will also be specific instructions on how to get your Canada work visa permit when you reach the Canadian Port Of Entry (POE). The instruction letter will be sent to your email account if you apply online. If you had used a paper-based application, you will receive the confirmation letter to your registered mail address.
c. Activate your work permit after applying from the Canadian port of entry
In exceptional circumstances, you may be eligible to apply for a Canada work visa permit after you arrive at the Canada POE. If you apply for a work visa permit at the POE, you must bring all the documents to help build your case for eligibility.
If the immigration officer is satisfied with the documents you submit at the POE alongside the application; then the officer may print your work permit right at the POE. This will allow you to use your Canadian work visa permit immediately when you enter Canada from the POE.
Your Canada work visa permit number is on the top right-hand corner of your permit documents and begins with the letter "U." Note that every number is different. Migrant workers can work in Canada only with a work visa permit. However, there are a few exceptions.
Migrant workers interested in working in Canada must get a written job offer from a Canadian employer to apply for a work visa permit. However, under certain exceptional circumstances, migrant workers like you can apply for an 'open work permit' without having a job offer. However, you have until the last day of the expiry of your work permit to apply for its extension.
